Carrying out a refurbishment of their House in Multiple Occupation (HMO), the client came under investigation by Southampton Council’s Planning Enforcement Team. ACHIEVE was approached to advise.
It was quickly established that notwithstanding the long-standing nature of the use, the last lawful use of the property had been as a home for vulnerable adults with learning difficulties, albeit at a greater density of occupation.
Advice was given to the client in terms of regularising this situation, in terms of how to word a statutory declaration and relevant evidence to be submitted to seek a lawful development certificate of existing use.
The necessary paperwork was quickly put together and the application made, at the same time keeping the council’s enforcement team appraised of this.
Close liaison with the council case officer and legal services who determine such applications for Southampton City Council, ensured a smooth ride to a positive decision with the Certificate been granted and the client’s investment protected.
